I. General provisions

The online store Diet-Plan.org, operated by Fitness Bartosz Klita with its registered office at 5a Odmętowa Street, 31-979 in Kraków, Poland TAX NUMBER: PL6783117163, hereinafter referred to as "Administrator", offers diet plans in the form of PDF files (hereinafter referred to as "Products, diets, diets or menus or menus").

The Terms and Conditions set out the rules for using the store, placing orders and completing transactions.

II. Offer of the store

The store offers digital diets (diet plans) to support healthy eating, available for download after completing the online payment or after the payment is credited to the target account, in case of lack of data or mistakes the payment is considered a donation to the venture.

All digital products are provided as PDF downloads.

Presented prices on the website are gross prices (include VAT if it is due, the entity may be exempt from such tax).

III. Placing orders

Orders can be placed through the store's website, missing or incorrect data will be treated as a donation to the project). Note what kind of menu is available with what calorie content and length, they vary.

Payments for orders are made through methods available on the website (credit card, online payment systems).

Once the payment is processed, the User will receive an email with a link to download the ordered product. The link will be active maximum 24 hours.

If the User has a discount coupon, he/she may reduce the value of the order by the amount specified in the terms and conditions of the coupon, provided that such coupons are issued and allowed for the product.

IV. Fulfillment of orders

Delivery of the product is made electronically by sending a download link to the email address provided when placing the order.

The product download link is valid for maxiumum 24 hours from the time it is sent.

V. Privacy Policy and Processing of Personal Data

Scope of personal data collected by the Administrator: name, surname, address, e-mail address, date of birth, IP address of the device and language (and the data provided by the User).

Purpose of personal data processing: order processing, tax purpose, payment processing, as well as for statistical and analytical purposes.

Period of storage of personal data: personal data is stored for the period necessary for the processing of the order, and after completion of the transaction for 6 years, in accordance with applicable laws.

VI. Complaints

Each user has the right to file a complaint. Complaints should be submitted via e-mail address: diet7plan@gmail.com.

Complaints will be processed within 30 working days.

VII. User's Rights and Obligations

User is obliged to provide true data when placing an order, for submitting false data or mistaken data may be subject to criminal liability.

The user may not share the purchased files with third parties or use them for commercial purposes without the consent of the Administrator under any circumstances. The menu is intended only for the buyer's personal use without the right to trade such a product, especially on a mass scale.

The user, by completing a purchase and using the website, agrees with the store's terms and conditions, the rules contained in the privacy policy and other information on this website.

By making a purchase in any form, the user waives the right to return the product in accordance with Article 38(13) of the Consumer Rights Act.

Complaints will not be accepted if the User wishes to change part or all of the product, nor will they be accepted in the case of errors in the selected menu such as word mistakes, typos, wrong approximation of the caloric value of a given product, incorrect portions, lack of logic in the composition of a given recipe or other unmentioned differences, which, due to the large scale of the store, may occur - the User agrees with these conditions and at the same time confirms that the complaint will not be considered in the case of a mistake of less than 30% of the expected product, which, according to the law, constitutes a minor difference in the expected product sought by the buyer.

VIII. Return Policy

In accordance with Article 38(13) of the Law on Consumer Rights, the User, by accepting the Terms and Conditions, waives the right to withdraw from the contract for a digital product, if the provision of the service began with the consumer's consent before the end of the withdrawal period.

In case of problems with the download of the product, the User should contact the Seller via e-mail or telephone, in case of messages, the response will be given up to 30 days, depending on the number of requests.

IX. RODO

Basic information on personal data processing:

The Administrator processes Users' personal data only for purposes related to the execution of the order and, in accordance with the law, no information is used anywhere, only those required by the laws of the Republic of Poland.

Users have the right to request access to their data, correction, deletion or restriction of processing.

Right to file a complaint: The user has the right to file a complaint with the President of the Office for Personal Data Protection (UODO).

X. Advertisements and trademarks

Advertisements or trademarks of other companies may appear on the Site. The User accepts the display of these advertisements, which may contain links leading to other sites, the Administrator is not responsible for such redirects or transitions to these sites.

The Administrator is not responsible for the content on the sites to which these links lead.

The User is not allowed to distribute trademarks and advertisements of other companies or entities advertising on this website without the consent of the Administrator,

XI. Liability

The Administrator is not responsible for errors in the data provided by the User that make it impossible to deliver the product.

The Administrator reserves the right to temporarily suspend the operation of the store for maintenance work.

The Administrator is not responsible for the inability to download the product due to technical problems on the part of the User, the Administrator's system is verified in various sources and works completely correctly on different devices, emails and systems and browsers.

XII. About Products

Each product is a digital product received at a designated email address or on paper, if so specified.

The products are informations created by the Administrator from his personal information sources.

Each menu has a name of its own due to the very similar type of diet in question.

In case of intolerance, allergy or other unmentioned possible risks after the consumption of a particular ingredient of the selected menu - such an ingredient absolutely must be replaced with another tolerated by the body.

Before using any product, it is imperative to discuss your chosen menu with your doctor or nutritionist, do not decide on your own on the use of any diet in your daily menu, the same applies to training plans, it is imperative to discuss the issue in advance with your doctor or a personal trainer or personal trainer specialized in this field.

The training plans are designed so that any person can without much difficulty perform a certain set of exercises at home without much specialized equipment, or at the gym with fairly readily available equipment for this purpose.

XIII. Final provisions

The Regulations shall come into force on the date of their publication on the store's website, valid from 14.05.2025.

The Seller reserves the right to change the Regulations. Changes will be announced here, i.e. on the store's website. The user should regularly follow changes to the Terms and Conditions and Privacy Policy if these could be relevant to him.

In matters not covered by the Regulations, the provisions of Polish law, including the Civil Code and the Law on Consumer Rights shall apply.

For any physical or digital product, a specialist, doctor or nutritionist should be contacted before using the selected menu.

If a person has food allergies or intolerances or other unspecified, certain ingredients should be substituted.

All terms and conditions apply to digital or physical products, if such will be delivered to the buyer at the address indicated.

There may be erroneous data in the products such as the name of the dish such as pasta with rice and carrots, may not contain carrots inside, due to the size of the venture such errors may be possible, the user acknowledges and agrees that such or similar errors are not and cannot be treated as grounds for return of purchase or complaint, the size of the error in relation to the total product is insignificant and cannot be treated as a difference when selecting the product.

All menus contain 3 meals for each day, and the caloric content of the meals is almost equally divided, that is, if, for example, a keto menu contains 1000 kcal each day for 5 days, it means that each meal will be approximately 333 kcal each day.
